Hold Harmless Agreement

By using the services and products provided by Eat Clean Pup (ECP), you acknowledge and agree to the following terms and conditions. By checking the required box, you indicate your acceptance of this Hold Harmless Agreement.

1. Purpose

This Agreement is intended to protect Eat Clean Pup (ECP) from liability related to the purchase, consumption, storage, handling, and use of ECP's pet food products by the Customer and their pet(s). By agreeing to these terms, you acknowledge and accept full responsibility for your pet's dietary choices.

2. Assumption of Risk

By purchasing and using ECP products, you acknowledge that:

  • ECP provides fresh, human-grade dog food formulated based on general canine dietary needs and, in some cases, tailored to specific pet dietary profiles.
  • You are responsible for ensuring the food is appropriate for your pet based on allergies, dietary restrictions, and health conditions.
  • Pets may experience allergic reactions, digestive sensitivities, or unforeseen health effects from consuming new foods, including ECP products.
  • You assume all risks associated with feeding your pet ECP's products.

3. Release and Waiver of Liability

To the fullest extent permitted by law, you release, waive, and hold harmless Eat Clean Pup (ECP), its owners, employees, contractors, affiliates, and suppliers from any and all liability, claims, demands, or causes of action related to:

  • Adverse reactions (e.g., allergic responses, indigestion, or any health-related issue) that may occur as a result of consuming ECP products.
  • Storage or handling mishaps (e.g., spoilage due to improper refrigeration, exposure to contaminants after delivery).
  • Misinterpretation of feeding guidelines or improper portioning by the Customer.
  • Delayed or lost shipments caused by third-party carriers or external conditions beyond ECP's control.

4. Customer Responsibilities

By purchasing ECP products, you agree to:

  • Consult with a veterinarian before transitioning your pet to ECP products, especially if your pet has known allergies, sensitivities, or medical conditions.
  • Follow all storage and handling guidelines provided by ECP to maintain product freshness and safety.
  • Monitor your pet for any adverse reactions and discontinue use if any issues arise.
  • Provide accurate dietary information if using ECP’s customization services, understanding that ECP formulates meals based on the information provided by you.

5. Indemnification

You agree to indemnify, defend, and hold harmless ECP from any claims, damages, losses, or expenses (including legal fees) arising out of:

  • The misuse of ECP products by you or any third party.
  • Failure to adhere to storage and feeding guidelines.
  • Any legal disputes resulting from the pet's consumption of ECP products.

6. Disclaimer of Warranties

ECP makes no express or implied warranties regarding the effectiveness, suitability, or results of its products. All nutritional information is based on general canine dietary needs and does not replace individualized veterinary recommendations.

7. Limitation of Liability

In no event shall ECP be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to veterinary costs, pet illnesses, or lost profits, arising from the use of its products.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state in which ECP operates. Any legal action must be filed in the appropriate courts of that jurisdiction.

9. Agreement to Terms

By checking the box on our website, you acknowledge that you have read, understood, and agreed to the terms of this Hold Harmless Agreement. If you do not agree with these terms, you should not proceed with purchasing or using ECP products.
